En la presente comunicación se les informa de lo siguiente / In this communication you are informed of the following:
- Que conforme a lo ordenado en la Sentencia número 195/2025, de 1 de agosto, del Juzgado de lo Mercantil 6 Barcelona (PO 1072/2025), de forma similar a las precedentes Sentencias de los Juzgados de lo Mercantil números 6 y 9 de Barcelona, España (*), se procedió al bloqueo de los recursos web (URL, Dominios, Direcciones IP), que se identifican en el presente comunicado, que están relacionados con el acceso ilícito a los contenidos audiovisuales propiedad de Telefónica Audiovisual Digital, S. L./Movistar Plus+ [NIF: B-87613816].
That in accordance with the Judgment number 195/2025, of August 1, from the Commercial Court No. 6 of Barcelona (PO 1072/2025), and similar to the previous Judgments of the Commercial Courts numbers 6 and 9 of Barcelona, Spain (*), the blocking of the web resources (URLs, Domains, IP Addresses) identified in this communication was carried out, as they are related to the illicit access to audiovisual content owned by Telefónica Audiovisual Digital, S. L./Movistar Plus+ [NIF: B-87613816]. - Que los bloqueos están siendo ejecutados por los operadores de telecomunicaciones ubicados en territorio español que prestan servicio de acceso a Internet.
That the blocks are being executed by telecommunications operators located in Spanish territory that provide Internet access service. - Que, sin perjuicio de los bloqueos ejecutados, los contenidos ilícitos continúan alojados en sus equipos y servidores.
That, without prejudice to the blocks executed, the illegal content continues to be hosted on your computers and servers. - Que, a la vista de lo indicado en el apartado anterior, le solicitamos que, de acuerdo con: / That, in view of what has been indicated in the previous section, we request that, in accordance with:
- Primero: el ordenamiento jurídico español / the Spanish legal system
- Segundo: la legislación española y europea aplicable en materia de protección de la propiedad industrial e intelectual y de responsabilidad de los intermediarios / the applicable Spanish and European legislation on the protection of industrial and intellectual property and the liability of intermediaries
- Tercero: las sentencias judiciales de referencia / the aforementioned court judgments
- Cuarto: las condiciones de uso de sus servicios / the conditions of use of your services
- Retirar los contenidos ilícitos, para que, desde sus equipos y servidores, no se continúe con la actividad ilícita, facilitándole en el fichero adjunto la relación detallada de las URLs y/o Direcciones IPs identificadas con contenido ilícito.
Remove the illegal content, so that from your computers and servers the illegal activity does not continue, providing you with in the attached file a detailed list of the URLs and/or IP addresses identified with illegal content. - Comunicar a su cliente que la actividad que está llevando a cabo incumple una orden judicial de un tribunal español, y que vulnera la normativa europea y española de protección de contenidos audiovisuales, y que, si no cesa en la indicada actividad ilícita ignorando la orden judicial, se le podría perseguir por un delito de desobediencia a las resoluciones judiciales y por delitos penales relacionados con la propiedad industrial e intelectual.
Inform your client that the activity they are carrying out does not comply with a court order of a Spanish court, and that it violates European and Spanish regulations on the protection of audiovisual content, and that, if they do not cease the aforementioned illegal activity ignoring the court order, they could be prosecuted for a crime of disobedience to court decisions and for criminal offences related to industrial and intellectual property.
