We are writing to you from Irdeto B.V. ("Irdeto"). Amongst other clients we currently represent EPIC Games, Inc. (“EPIC”) with regards to the protection of their intellectual property rights on the internet regarding the game Fortnite.
It has come to our client’s attention that there is currently content on forecheats.com [192.124.189.57], hosted by InterLIR which infringes their intellectual property rights, specifically the sale of software that is aimed to bypass security measures put in place by EPIC Games.
The reported products are designed and developed to circumvent Epic’s technological measures which are in place to protect Epic’s copyrighted works, thus constituting a violation of 17 U.S. Code § 1201 (a). As the infringing software which is sold on the Merchant’s site is aimed to bypass security measures in the game Fortnite, this constitutes copyright infringement under the DMCA, as previously ruled by US Courts (please see Bungie case: https://torrentfreak.com/bungie-wins-16-2m-destiny-2-cheat-dev-violated-dmca-rico-cfaa-230510/). Such actions violate the DMCA and constitute copyright infringement.
EPIC has the exclusive rights to copy, share or sell any creative elements that are protected by copyright. This is regardless of whether the copyrighted material itself is being sold, as outlined in 17 U.S.C. § 501(a), which states that infringement occurs when someone violates any of the exclusive rights of the copyright owner.
